The state wants to take my son's parental rights away due to his past

In 1997 my daughter-in-law (now) got into a car accident with my grandson. She was intoxicated and the state stepped in and took him away(only gave him to her mother). My son wasn't involved in the accident, but because they lived together and due to his petty criminal background they took him away from him also. This I do not understand, because my son has never neglected or endangered my grandsons life as his mother did. But they took him from my son because he has been in trouble . He is now in prison , not because of such a bad crime, but multiple little things that added up. Well, he was court ordered to complete all of these classes and he has not been able to do them because of where he is. So the state has proved him unfit, for not completing the classes. Now they want to take his parental rights away for not doing what they ordered and because of his past criminal history. He went to prison for getting into a fight, then violated his parole by taking a 4-wheeler that did not belong to him, so he went back. My son and the mother were married in 1999 and are still married, but she lives with another man who she makes my grandson call dad. Her mother is behind all this trying to make my son seem worse than he really is, because he is really a good kid, just made a few wrong choices early in his life, he is 23. He does not want his rights terminated , he loves his son very much and his son loves him, too! How can they do this to him . I thought you lost your rights when you neglected or showed abuse to the child or endangered his life, not because of your past. I need advice on this , I do not feel this is right, and the public defender isn't doing too much of anything. I can't really afford a private attorney at this time. My son should be realeased in about 17 months. I need some help, because I am sure her mother has a hand in all this and so does my daughter-in-law, they have been lying to the caseworker, I know for a fact.
