What is the name of your state (only U.S. law)?

I used to get SSI as a kid for ADHD/Severely Emotionally Impaired. Then I got cut off when I went to college. I tried several jobs after college, all temporary and internships. The first one, my boss suggested I might need depression meds. Then on another job I had a near mental breakdown. Then finally I totally lost it and after several dxs and stuff I am not labeled as schizoaffective bipolar-type. I am on meds now and they mostly control symptoms and I tried to work again, but I got fired because of not physically able to handle job, then even on meds I spiraled into depression then mania and ended up a mess. My main problems even on meds are my moods and also bad social skills/not being able to relate to people well.

I already get a small Michigan disability check for almost 300 a month, and medicaid for disability.

Anyway, I do not have enough credits to claim SSDI, but I read something you might if you were disabled before 22 and your parents get it. I had a legal guardian instead and she gets SSI right now for elderly, so would I be able to get it based on that?

Second, basically enough of a case? In the past a couple of my jobs I was able to handle, but any stress can destabilize me. Right now, they are readjusting my meds.

If not through SSA ,file for both SSDI and SSI at the same time .

SSI eligibility when one turns 19 has higher standards that when under 19 ,but with your DX ,you should be able to receive at least SSI , but again file for both .

Also be aware , you can use the back to work incentives and still earn under the SGA level while on SSI ,and depending on your credits could qualify for SSDI and some point in the future.

Well, I talked to some people for legal advice and actually I don't think I have a good enough case. If I am not under lots of stress, people can't even tell I have such a dx.

The 300 dollar check is called state disability, I got it through social services.

DX - schizoaffective bipolar-type.

This is a severe disorder .

Don't talk to legal persons .Talk to your treating therapist / psychiatrist and see if they are on-board that you can not work at gainful employment.If so file . They will fill out the forms SSA sends them .

You do not have to be walking around acting loony to qualify .:rolleyes:

12.03 Schizophrenic, paranoid and other psychotic disorders: Characterized by the onset of psychotic features with deterioration from a previous level of functioning.

The required level of severity for these disorders is met when the requirements in both A and B are satisfied, or when the requirements in C are satisfied.

A. Medically documented persistence, either continuous or intermittent, of one or more of the following:

1. Delusions or hallucinations; or

2. Catatonic or other grossly disorganized behavior; or

3. Incoherence, loosening of associations, illogical thinking, or poverty of content of speech if associated with one of the following:

a. Blunt affect; or

b. Flat affect; or

c. Inappropriate affect;

OR

4. Emotional withdrawal and/or isolation;

AND

B. Resulting in at least two of the following:

1. Marked restriction of activities of daily living; or

2. Marked difficulties in maintaining social functioning; or

3. Marked difficulties in maintaining concentration, persistence, or pace; or

4. Repeated episodes of decompensation, each of extended duration;

OR

C. Medically documented history of a chronic schizophrenic, paranoid, or other psychotic disorder of at least 2 years' duration that has caused more than a minimal limitation of ability to do basic work activities, with symptoms or signs currently attenuated by medication or psychosocial support, and one of the following:

1. Repeated episodes of decompensation, each of extended duration; or

2. A residual disease process that has resulted in such marginal adjustment that even a minimal increase in mental demands or change in the environment would be predicted to cause the individual to decompensate; or

3. Current history of 1 or more years' inability to function outside a highly supportive living arrangement, with an indication of continued need for such an arrangement.

The worst thing that could happen by applying is that you would be denied and you would be in the same boat you are today. The best thing that could happen is that you would be approved.

File a claim. Today is the last work day of May. If you wait until Tuesday to contact SSA to make an appointment, you will have lost May as a potential SSI eligibility month.

Take the weekend and work on your online claim. Be thorough. Allege an onset date as far back as possible. Be prepared to give begin and end dates of every job you've ever had since you are claiming those are unsuccessful work attempts. Finish it in your local office.

You cannot get benefits based on a legal guardian. Are your natural parents deceased, disabled or retired? You also cannot qualify for benefits based on a parents' SSI entitlement.
