I was hired as a consultant in the IT department of a large international company approximately 6 weeks ago. I immediately submitted my W-9 form as I was hired as a 1099 and am expected to pay my own taxes. I was told by the administration that they had all the necessary paperwork to process my timesheets. I have since submitted 5 timesheets for a total of approximately $8k and have yet to receive a paycheck. I have followed up with my direct manager but am always told there isn't much he can do at this point because payroll was processed at headquarters in Texas. I'm trying to be patient as I don't want to ruffle any feathers, as I was originally hopeful of landing a full time gig. No questions or problems have been presented to me that would explain the delay.

Is there any time frames they must adhere to when paying consultants? Am I to be treated with the same laws pertaining to FT employees?

Thank you

"Is there any time frames they must adhere to when paying consultants?"
*** No. You are an independent contractor and are, in essence, the same as an outside vendor. Though I would think that the delay you show is excessive.

"Am I to be treated with the same laws pertaining to FT employees?"
*** No. Those laws are written to protect employees. You, as you noted, are not an employee, but an 'independent contractor'. The bad news is.... if they don't pay you, you will have to consider litigation.

I would suggest you sit down with your immediate 'client representative' and try to determine when/if you are going to get paid...... and consider alternatives if needed.

Just a quick question.

Did you receive this contract through a staffing agency or through the employer directly?

This was through the employer directly. Unfortunately for me, there was no contract either. All I have are copies of my submitted time sheets signed by the manager that include hours, wage and total due. I do believe I'll ultimately get what is owed to me, I just think their main office is a 'bit' slow with their invoice payments.

Thank you
