What is the name of your state (only U.S. law)? California
My wife signed a General Power of Attorney last June, 2007 when we were about to sell a property in the Philippines. This was notarized here in Los Angeles, California. It stated that I have the power to act in any transactions. I intend now to roll-over my retirement plan from Kaiser which I participated in the 70's till my retirement in 1998 which is prior to my marriage with my current wife. Vanguard Group who is managing Kaiser Plan and where I would roll-over my employer vested retirement plan stated that my wife must sign a consent and have it notarized. My wife refuses to make a consent as we are not recently getting along well. Can I use the POA she signed in 2007? What should I do?What is the name of your state (only U.S. law)?

I doubt very much that Kaiser will accept the POA for this purpose. Further, since your wife has specifically instructed you otherwise, as anteater said, you'd be in deep trouble trying to do so.
