I live and work in Texas, but my employer is headquartered and operates out of New Jersey. The last payroll check sent didn't process and was returned for insufficient funds. That check was for pay period ending 6/11/04, it was issued on 6/18/04. We are paid every two weeks. I need to know if I fall under the Texas employment rules or the NJ employment rules. I would think it would be NJ since that is where my company is Headquartered. I am most concerned with my rights as an employee and the time frame, by law, they have to make the wages available.

Texas. An employer must comply with the laws of the State in which the employee works, so your employer must follow Texas reg's for their employees located in that State and NJ reg's for their employees there.

If your employer still hasn't made good on that paycheck, contact Texas's Department of Labor and file a complaint. I'd also start looking for another job. Payroll checks bouncing does not bode well for your future job security.
