A friend of mine's 18 yr.old daughter bought a car 5 days ago. She found it on a website called Craigs List & in the advertisement it said that all the car needed was to be cleaned up. They went to see the car & paid the owner $1200 cash. The car looked clean/good & ran fine. Unfortunately they never had a mechanic look at it , which was a HUGE mistake on their part. The only thing they knew upon buying it was that it needed a new radio/stereo because the original had been stolen w/the wires cut. The owner also told them & gave them the Marta slip where it had passed Marta in the past, saying they should have no problem w/Marta testing. After taking it home, they realized the starter was going out, which they didn't find to be a big problem at the time. On the 3rd day after buying this car, they were about an hour from home & the engine got hot & basically stalled on them. She had not even had a chance to go through Marta yet! After the car died & having it towed, they realized that the harmonic balance was wobbly, the thermostat was shot, which is probably the reason for the car overheating, & their was a smell of gas in the oil. Which means that either the heads are blown or the head gaskets are blown, which is a guess being we are not professional mechanics. Is my friend's daughter due to her money back under the lemon law or is she out of luck being it was an individual seller on the car? The car is a 1995 Sunfire w/less than 75,000 miles on it. They haven't been able to reach the seller by phone & their not sure if they even have a leg to stand on in this situation. A new motor will cost $800 plus the labor & any parts extra they will need. Any help on how to pursue this matter will be GREATLY appreciated!

Sorry but the lemon law does not apply to private party sales.

Are you asking for help in getting her a better price for the motor in her new car? I don't know - shop around, maybe try junk yards, etc...

Oh, you meant is there any way for her to get her money back on her 13+ year old car with 75,000 miles on it. No, nothing for you there...

Replace the thermostat and harmonic balancer. Then replace the oxygen sensor, as the car is running rich (causing the fuel in the oil smell).

No blown head gasket signs here, other than the overheat, and that was caused by the thermostat.

BTW: What do you expect out of a 13 year old car sold for $1200? It ain't gonna be no Lexus.:p
