If there is cause for a negligence claim due to the dismissal of a default case for failure to prosecute (failure to prepare and present prove up), is there any way around to toll the filing statute for a new claim against the attorney? If there is a separate non-related matter that was still ongoing whereby they were also negligent, would that help? What else?
