Took Care of Foreclose and still had to move???

Last October we were a few payments behind on our mortgage when we were served with Foreclosure paperwork mentioning that our house would be sold soon. We immediately called the Morgage company and talked to them about options for keeping the house. We came to and agreement that we would make up back payments by paying them $5,000 for the next 2 months. this would completely cover the back payments and then some.

8 months of regular Non-late payments later which was just july 31st we get a 10 day notice to vacate. We were shocked to say the least. No payments were returned at all so I was floored at what to do. We paid them nearly $20,000 in the last 9 months and still get a notice to vacate. The person that we had the agreement with at the bank simply gave us the "I need to get back with you" for the whole 10 days so we got no where at all.

We call a local attourney and gave them the case #. They checked it and said that they sold the property in February. So they didnt sell the house as per the phone call agreement but did 3-4 months later. We made several payments after it was sold as well.

We had about approx $40,000 in equity after the payments were made to them so I am assuming they just found a home with some cash potential and went with it. Am I wrong??

Also would they have to pay any of the money back at all in the time frame from our call to the day we left?
