OK, I need your thoughts . . .
If someone parked in my driveway (private property) or up in my lawn, I can have his vehicle towed, right? (side question; who would have to pay for the towing?)
I own 2 PUD's (like a townhouse, 4 connected together) in an 8 PUD community (I do not live there, I rent my 2 out, as well as 1 other LL, the other 5 are owner occupied). Everything has been fine, everyone got along, respecting each others parking spaces . . . until recently. One of the owners has rented out his PUD to a real jerk. The tenant (and/or his guests) are constantly parking in other peoples assigned, marked, parking spaces or in the grass. Throwing the beer cans where ever they feel like it, etc. Everyone has had enough as the grassy area in now a mud pit with deep ruts. (In the last 24 hours, we've had 3 inches of rain.)
Tonight, when I was there, I again, see the guy park in the grass (now all mud raining while I was there). I called the police and asked for a "property damage report", as I intend to insist the PUD owner/LL pay for repairs to the lawn (as verbal and written warnings to the tenant not to park in the grass have gone unheeded.) The police showed up and said the guy can park in the grass because it is not marked "no parking". I told the officer it was in violation of the R&R's and they have been told not to park on the grass. He said it didn't matter, it has to be posted.
1) Isn't this considered small parking area considered private property? (It is not maintained by the city, but by the 8 homeowners.)
2) Like my own driveway and lawn, can't I have a vehicle removed if they park there?
3) Does private property have to have "no parking" in areas where normal people know not to park (i.e grass)?
4) The R&R's just address limiting owners to park only in their assigned spaces and not on the grass, but does not say what the punishment is for offenders.
