Short overview of the situation. I parked my car in a parking lot in which i was "tresspassing" because I did not have a parking sticker to park there.. My car was towed by the company contracted by the property owners. I made arrangements to pick the car up, was told I can only pay cash - No credit cards accepted for relocation.
Being a college student, I dont have much cash, let alone cash on me at 2:00 am to pay the towing company. This is my problem. I am not disputing the tow at all, I knew the rules of the lot and disobeyed them - I trespassed and was towed.
Illinois Motor Vehicle code 625 5/4-203:13 states that any towing company who does relocation must accept major credit cards for payment and notify the police in the event of relocation within 30 minutes of completion of a relocation.
I was told I can only pay cash.. This is a violation of IMV code, also the police were never notified about the tow (the city has less strict rules with the time frame - 3 hours)
Also the city code states that if a relocation company accepts Credit cards for any service it must take it for relocation tow bills as well.
There is no question by me if they are in violation, I know they are. However, My question is can I sue them, or must the lawsuit be brought by the city/state attorney because it is a violation against their codes not a violation against me. If the lawsuit must be brought on by the county, how can I get that started?
