What is the name of your state? California
My ex lives in Georgia; we have a court order, which we modify when I moved to California. No signatures by the judge. Son goes for the summer and every other xmas. It has been some what ok for about 5 years but got worse every year on his part. Finally I filed with CDSS, they are inforcing original agreement, which I want because I want them to collect the support for me. I’m also having a lawyer change the agreement to meet the summer every other xmas part. The question I have is as of right now the agreement says my son is to visit his father every other weekend. He has not. Which I would somewhat think was contempt but his father has not asked or complained about it. I’m I in contempt? I’m not stopping it from happening.

No, you two agreed to the change...therefore you are not in contempt.

She clearly states that this was not signed off on by the judge.

He would not be in contempt since he is under no obligation to visit, you are the one under obligation to have the kids ready for the visit, but since you moved this is not possible really. So while he may have a valid argument (you moved, you pay for the every other weekend visits) this will be disruptive to the kids, and you need a new court order.

I am in the process of getting a new court order, which will have better visitation rules so this is not a problem any more. I should have done it when I moved, but I thought it would be ok. I’ve learned a lot about getting everything in righting and not waiting. Thanks for the help
