I am English and married a US citizen in November 1997. We applied for immigration through lawyers in Feb 1998. Unknown to us the lawyers legal clerk forgot to forward our paperwork to the INS. When she eventually forwarded it, it was returned to us because she had'nt sent the right payment. We then returned it to her and she eventually sent it off to INS. She then sent travel permits. We found out through another lawyer that i could'nt use these because of the 180 day rule. I then informed my lawyers of this, who agreed, and said don't use them.
I have now not been home for 2 and a half years. The lawyers say my interview should be
in the Spring but that's anybody's guess. Is there anything I can do here? I am desperate to go home for a visit especially since my brother has just had a stroke? I would be grateful for any advice here. Thankyou

go to the nearest INS office and file for an advance parole ( or I-512) single entry or multiple entries... it will costs you a maximum of 100$ and will give you permission to leave the country when you want to.
You can leave the country and re-enter again without any problem. I also filed for greencard and I used this paper to visit my family in june in belgium and I went for a holiday to Mexico in september. Both of the times I had no problem re-entering the US.
There is nothing that you prevent you from not visiting your family or friends in this case.

ONe good advice , dont do it thru a lawyer ... I did it by myself and it took me not even 14 days to get it. you will also need two or three passport pictures.

Thankyou, but if i apply and get Advance Parole and leave the country they will know at my interview i was out of status and not give me my green card.
