What is the name of your state? New York
I am not ready for a divorce, but I want my husband to leave the house and get it together and see if he is really part of this marraige. Do I have to file for a legal separation? Doesn't that mean I want a divorce after a year? Advice please.

How is he going to be a part of the marriage if he "gets it together" outside the home?
Have you tried marriage counseling?

Why don't YOU leave the house while you are waiting to see if he "gets it together"?

I don't see why you should leave. I am going through the same situation but needless to say no matter where you turn there are no easy answers. only whats in your heart. as far as this free advise I find them to be be rude and heartless. I wish you luck and happiness:rolleyes:

What does your husband have to say about this plan? If it's his house as well, you'll need a court order to make him leave unless he does so willingly.

I have to agree that perhaps counseling would be a better avenue to pursue, as well as something like retrouvaille.org or marriagebuilders.

This is NOT a support group. We are not here to provide peace and comfort. We are here to tell people what the law says. The law says she cannot make him leave without a court order. Everyone else was telling the truth.

Why should the house go to mom when she is the one that wants out of the marriage??

And OP hasn't even responded to my question about marraige counseling. No marriage gets "rescued" just by kicking the hubby out for a while!
