Issued a citation for:
• Unsafe lane change
• Unlicensed driving
I plan to go to trial for the unsafe lane change (I'm almost positive that I will be found “not guilty.”
Regarding the unlicensed driving:
A record check showed that it had been suspended. Since it is my right not to incriminate myself, I acted totally surprised by this. The license info also stated that I needed to be served so I wasn't issued a “Driving on a Suspended License.” The officer did not take my license away from me because I didn't have it on me at the time.
I went to court to get an extension and the clerk asked me if I had my license. If I did she would check the violation as “fixed.” I also received a courtesy notice which read that I could send the $144 by mail for the unsafe lane change along with proof of correction for the unlicensed driving.
On the notice to appear from the officer the citation was checked off as not correctable and a Misdemeanor.
I want to show my license to the clerk in hope that the unlicensed charge will disappear. However, am I being paranoid to think that this is some kind of trick and I could have additional criminal charges if I dare show my license and act as everything has been “fixed”
