Trying to buy a foreclosed home with a restitution lien

What is the name of your state (only U.S. law)? Illinois
I am trying to buy a foreclosed home in my hometown. The previous owner got into trouble with the law and on may 2010 was sentenced to 21 months and 3 years probation. As well as $116000 in restitution for wire fraud, making that a federal offense. On May 20th 2010, the government put a lien of 116k on his home. He was the primary breadwinner of the family and when became incarcerated the mortgage didn't get paid. In dec 2011 the home was foreclosed on. We put a offer in on the house, and then the house went off the market without any explanation. Months have gone by and recently i called the realtor and she stated that the people were fighting the foreclosure. How can the people fight it? They have already been foreclosed on. The bank can't sell the house with the restitution lean on it can they? The bank bought the house back at the auction for 260k the lien is 116k. They had the house listed at 259,000 when it was on the market. I think the house is worth 275-290. How do I get this house bought with out assuming the 116k lien. That's the guy that broke the laws responsibility. Will the government release the lien on the house so the bank can sell it? Any advice or comments welcomed.

**A: you can't throw out the lien just the same as you can't say "I want to buy the house without the mortgage since I didn't cause it"
