I believe I have been discriminated against because the company I work for is not reimbursing me under the tuition reimbursement policy because I attend on-line classes. I have emails to prove this is the reason; but they have not even returned my reimbursement form.
The policy states "accredited colleges and universities and trade schools" it does not mention anything about whether the classes are on-line or not. The VP of HR stated in an email he is not sure the level of education I can get in online classes?? Should I file an EEO charge?

Ditto. If they are denying payment for all online classes, there is no discrimination that is illegal.

You really should have made sure you would be reimburse BEFORE you elected to take the course for the school.

I think your HR boss is a dim bulb, but what do I know.

Fringe Benefit Discrimination

The policy reads "enroll" not attend. I also believe they have paid for on-line classes for others; I just cannot get that information. VP of HR is questioning in emails the level of education I can receive from on-line classes. In addition, I do attend class, via headset into a virtual classroom with professor and other students, and classroom time is recorded - the only thing I do not do is drive my car to campus, get out and go literally sit in a classroom, it is not independent studies by any stretch of the imagine where you work at your own pace.

We are to send the paperwork for approval in 2 wks before class starts, I sent mine in 3 weeks prior. I have never received it back from anyone and when I started asking, the emails started flying and then everything died down and here I sit w/no rejection or approval. I have written the president of the company and he agreed that I should at least get my paperwork back stating approved or denied and so far nothing yet. It is not about the money, it is a matter of principal. I would have taken the class regardless, it is my last one before beginning my thesis.
I agree that the VP is a dim bulb, who has been out of school 30 years and is technologically challenged. I have only been w/this company for 1 yr and am trying the best I can to get out. Their policy is totally outdated to begin with, only a $2k max payout annually; and one class for grad work is $2k plus, but tuition reimbursement is listed in the "major" benefit overview in the policy manual and I know other people have gotten it.

No, you haven't.

You can try... but they're going to round-file your complaint within the first five minutes.

Discrimination based on taking classes online vs a convention college is NOT illegal.

Discrimination based on your age, race, gender, or sexual orientation IS.

Unless you can prove one of the above, this is going absolutely nowhere.

Well I agree curt but you forgot disability... If this case is one of a required class and not allowing her to take is amounted to a lack of accomidation... I doubt this but in the interest of fairness I do mention it.

Further, it is unlikely, but it is possible that this poster has an employment contract of which this policy on reimbursement is a part. The poster has said nothing about an employment contract, and in such a case the EEOC would have nothing to do with the contract dispute.
