Since the thread is closed, cause JETX obviously deleted the corrections I made to your statement, CAUSE knowing I am RIGHT!

NOW BEFORE YOU START MAKING RUDE COMMENTS TO ME (and TRY to tell me its easy to avoid):

ALL OF YOU, GO TAKE A DRIVE ON A LIGHT TRAFFIC DAY ON THE FAST MOVING TRAFFIC FREEWAY. THEN GO AHEAD AND STOP YOUR VEHICLE COMPLETELY IN THE MIDDLE OF THE FREEWAY. And see how long you will go without getting hit!!! I dont think youll dare do that would you??

Well anyway. I have reached the complete conclusion of the case of the stopped car in the middle of fwy. The police report says: (Ill type s-l-o-w-l-y for you JETX)



CAUSE :

PARTY #1 (ME) CAUSED THIS COLLISION BY VIOLATING SECTION 22350 C.V.C. - UNSAFE SPEED FOR CONDITIONS ; STOPPED TRAFFIC

PARTY #2 (STOPPED CAR) IS AN ASSOCIATED FACTOR TO THIS COLLISION BY VIOLATING SECTION 22400(A) C.V.C. - IMPEDING/BLOCKING TRAFFIC, OR COMPLETELY STOPPING, UNLESS FOR SAFE OPERATION OR IN COMPLIANCE WITH THE LAW. BASED ON HER OWN STATEMENT, P-2 STATED THAT SHE DIDN'T ATTEMP TO PULL OVER TO THE RIGHT SHOULDER BECAUSE WAS REALLY NERVOUS.


As I see it. Its just like the ANSWER I received from all the info, you guys and OTHER sources gave IN THE FIRST PLACE before you STARTED A "BRAWL" WITH ME.

What do you all think of that?? It WASN'T 100% MY FAULT WASN'T IT!!

Now that my memory is a little more clear. What actually happened (JUST TALKING ABOUT MY EXPERIANCE ONLY).

When I entered the fwy, I was getting up to speed, then I guess I remember that traffic started slowing. I thought it was traffic just being stupid. So I set my judgement for "slowing traffic". Then car ahead changes lanes swiftly. Then saw the stopped car. NOW THIS IS WHERE I FEEL ACTUALLY HAPPEND IN MY MIND. I made an error in my judgement. At first I thought it was a just a slow moving car. (my judgement was based on thought to be 'slow' car. So I braked accordingly). THEN I was "smacked" when I got the suprise that it was actually a completely stopped car, NOT a slow moving car. And because stopped cars in the middle of fwy are the RARE EST thing to happen to me. And that's where my mistake happened. Certianly didn't expect that one! And going 60 mph, Im approching the stationary object VERY QUICKLY (Go see for your self, the next time you go on fwy) And needed to spontaniously "adjust" my judgement to 'stopped car' I had no time! I was NOT speeding nor tailgating. It was an error in my judgement.

And for me: I am a male with 20 yrs of driving experiance (200+ a day Mon - Fri for last 12 yrs). This is ONLY the SECOND fault accident I ever had.

Avoid a brawl, no comments that are MEANT to make me look bad, please

SO it seems that for MY PREVIOUS thread "I rear ended a car that was stalled in the middle of freeway" . I SAW THAT IT RECEIVED MANY MANY VIEWS (MORE THAN 500). Now that's to show HOW RARE SOMEONE COMES ACROSS a situation like this!!! Makes MANY people very curious about the my thread

Crazy someone would stop in the middle of the freeway. Not sure what part of california you live in ,but drivers in California all realize traffic stops very quickly without warning. Not famialar with the laws you stated, however, a wealthy business man slammed into the back of me with his brand new Cadillac. I was following traffic. So the state police came and the first question I asked was-is there anyway this could get pinned on me. He said if someone rearends you, if you were illuminated, 98% of the time, its the other persons fault.
But I agree with you, someone that stops on a major freeway should lose their license for a long time

These kinds of accidents are VERY TRICKY to avoid! My particalar case: I really could not avoid this particular situation. (OR it was why TOO TRICKY anyway) With cars blocking my view, and our minds NOT SET UP to expect a stationary object, its going to happen. What happens when someone was talking to his passenger and took his eyes off the road for just one second, the gets "smacked" by what we totally don't expect!

You are 100% responsible for the accident.

And, all your driving experience means squat to me. I've been driving longer and have NO at-fault accidents. As have many, many other people out there.

Funny, in California traffic, in just the situation you described, my mind IS set up to expect a stationary, or very near stationary object. Furthermore, what happens when someone is talking to his passenger and takes his eyes off the road, he is negligent.

You also must realize that the issuance of a ticket does not mean the person was guilty of the charge. She may consider fighting the ticket and may possibly win.

Didn't you say something about she ws dragging something with her car? She may argue that she felt it was unsafe to move her car so she was where she was.

California is not a contributiry negligence state so you will still be held liable for the greater part of the accident. How much will either be determined by your insurance comapnies or the judge or jury if it gets that far.

as the old idiom goes, "don't count your chickens before they're hatched"

Oh, by the way, the police do not have the authority to decide who is at fault. They write tickets if they believe they are warranted but that does not mean what they state is true or correct.

As to who does decide who is responsible; I already told you who does that.

Well Im tired of me being the one CRUCIFIED for something for someone else's stupidity of risking his/her life to stop the car BY CHOICE. EVERYBODY KNOWS that a stopped car in the middle of fast traffic is a GUARENTEED accident to come. IT'S GUARENTEED


I have put a new thread solely so I can SHOW you guys the REAL facts (What police investigated, the report) before you guys automatically assume things THAT ARE NOT TRUE because of what I look like.

I will ONE MORE TIME state the REAL facts:

DO YOU DRIVE 200 MILES A DAY? 60,000 miles a year for the last 7 years??

Funny thing is that it's YOU being crucified for not allowing the proper following distance for conditions. With your vast driving experience, maybe you forgot the basics...

I, too, have banged my head against this wall enough. Good luck - I'll enjoy watching you jump up and down and hold your breath until we all agree with you - but I won't join in the fray any more :cool:

You wouldn't be crucified if you would stop posting such inanity.

I already told you. I drive on the freeway every dang day AND there is about 2 hours in a 24 hour period that traffic could be considered "light" (I think it's between 3 and 5 am, but I won't swear that there isn't a lot of traffic then, either). I even remember part of my driver's ed taking place on Central Expy (and that was BEFORE they 'fixed' it). Amazingly, I have never had an accident and, for the record, I have never been known to drive at or below the speed limit while on the freeway. I have no desire to get smooshed. I've always managed to stop in time.

NOBODY, but NOBODY agrees with you. We are all in agreement that the accident was your fault and that you are proving that you really shouldn't be driving on the freeway, to begin with. Take the access road and keep it under 45.
