TX child support and visitation

What is the name of your state? TX

I am an unwed mother, baby due in a few weeks. I am currently on Medicaid with minimal income.

Father quit his job 3 months ago (in CO where we both lived at the time) and moved to NY. I moved to TX for support from family.

He moved in with his parents to help get ahead and pay off personal debt and start his own business. His parents helped him get a $20K loan for his new business which he has been living off of and spending to get it set up. So far, he has barely worked for income. What he has earned he says he is not reporting.

I think I understand that child support will be based on his last year's earnings but what happens if he continues to go further in debt and earn/report no income?

Secondly, he has no plans to move to TX, yet thinks it is unfair that he will have to pay all of travel costs for visitation, or that he should have to come to Texas everytime he wants to visit our son.

Is there any chance I will be obligated to pay any portion of his travel costs or travel to NY with an infant?

In Texas they consider the past two years for the child support. There is also a minimum, I'm not sure but I think it's $200.00 per month and insurance. Yes, he's going to have to pay for traveling if he wants to see his kid. And since your baby is going to be born in TX, well then!!

No. The baby will be born in TX. He will have to file in TX for custody/visitation in order to even have visitation. He will have to establish paternity prior to even filing for visitation. IF he does all of that, you can ask that child support be established at the same time.

If does none of that and you want child support, you will have to establish paternity (likely DNA testing) first, then child support through the courts.
