Uncontested Divorce - both parties signed paperwork

What is the name of your state (only U.S. law)? Alabama.


I have a signed all required paperwork signed. I had to get my spouse to sign an amendment because certain verbage was written wrong by my lawyer's secretary and the judge rejected it. My understanding is that the court will not give me a court date until atleast 30 days after the paperwork has arrived. So does my 30 days restart after they received the amendment?

Also, my lawyer stated since the divorce is uncontested neither party has to show up to the court date. Is this true? I'm skeptical because his office has made numerous mistakes and they have forced me into being married a least 2 months longer than I should have. Needless to say anything I hear from him is taken with a grain of salt.

Ask the court clerk. They can't give legal advice, but I don't think either of those questions should be a problem.

I actually called before I read this message. lol

Clerk said there isn't a "court date" for uncontested divorces. Said once the judge gets to the amendment the divorce is final. Couldn't be more specific but they said they don't hold it for another 30 days. So....it all depends on the workload of the judge. I could be divorced in days, or more likely a few weeks.
