My husband and I purchased a manufactured home two years ago. It was a used home and the note was assumable. We have been backwards and forwards through the purchase contract and it clearly states that any and all fees for assuming the loan were included in the amount financed.
We are now looking to sell the home. We inquired at their website last night as to what the payoff his. Our principle balance is 33k. We originally financed the home for a little over 35k. Our problem is on the payoff statement they have added in 5600.00 dollars in fees and legal expenses on to the end of the note making our actual payoff around 38k.
Can they legally be adding all these fees onto our note? There was nothing in our truth in lending disclosures about adding fees and expenses on when we paid off the note. As a matter of fact it specifically states that we are not penalized for early payoff.
By the way our mortgage company is operating in bankruptcy...
