Hey folks for anyone with familiarity with unemployment in South Carolina...

I was let go prematurely by my employer three months ahead of time due to getting someone new in my position to be trained for my specific task as I start medical school in Greenville,SC in August. They paid me two weeks of severance and I was let go. Long story short, I was denied my benefits originally due to the fact that through a miscommunication with my employer who said that I had resigned (not the case, I was set to resign August 10th due to medical school on August 15th). Spoke with my employer who sorted the whole thing out, said they would not contest and I had a hearing on Monday which the employer didn't contest and now I'm waiting to hear the result. From the point that I was denied benefits, the automated service said my benefits were "EXHAUSTED". However, now today, when I called, it's giving me the actual amount again that I'm entitled and online it says I'm entitled to $6250.00. The women on the phone can't disclose the decision but said a decision was made earlier this morning. Should I take this as a good sign?

This is very much a state thing. Some states allow quits to become discharges when an employer accelerates a last day, and others don't. It's sometimes difficult to find out how a state sees it unless you find a precedent decision guide or know someone that's been through it.

Should I take this as a good sign?

Because the root cause of your "quit" is disqualifying, I sure wouldn't be making any plans based on the information "changing" in such a meaningless way. Just wait for your letter or the issuance of a payment.

Did you have a prior claim? "Benefits exhausted" indicates something that has happened previous to this on an old claim, possibly in the old benefit year.

That you were unexpectedly let go three months before the date at which you had already intended to quit may qualify you for benefits. We can't decide from here. If you were let go much closer to your date of intended termination, (which would have totally made you ineligible for benefits, as you quit of your own volition to go to medical school, which is a personal reason, South Carolina doesn't like personal reasons to quit)there is little chance you may have qualified for the time before you were planning to leave. As it is, it might just happen, as the employer elected to let you go significantly before you would have left on your own. A lot can happen in three months. But I surely wouldn't count on it. What you are seeing going on online right now, that you are "qualified" for $6000 and some odd dollars just means that your new claim has set up. It does NOT in any way mean that you are able to begin drawing a claim, it just means you are monetarily eligible for a claim. Maybe it will work out, but you will just have to wait and see.

If the decision goes against you, do appeal it again, you have nothing to lose.

Just found out it was reversed

Just received a letter and found out the phone appeal was successful and my benefit eligibility has been reinstated. Chyvan, at this point, what happens now?

If you've been filing your weekly claims, you'll be paid for all weeks that were suspended, and things will go back to normal.

If you weren't filing your claims, then your claim was most likely "closed," and you have to get it "reopened," and all your unclaimed weeks are most likely forfeited.
