this concerns new york state. i hired a "father's rights attorney" because he was referred as "one of the best if you can afford him". On our initial meeting i posed this as a concern if it would hurt my case. he assured me it would help my case knowing everything that was available to my husband. For the first six months this attorney did a fair job representing me. In January 2001 at a conference with myself, my attorney, my ex, and his attorney, it was agreed that my husband would re-instate my children's health insurance. (Previously, i had carried the insurance, but my husband insisted on carrying the insurance, due to another child needing coverage and it would cost him nothing to carry my children. I had it written into my legal papers (prior to hiring this attorney) that once the children were transferred over to his insurance, he would forever be responsibile for the coverage, at his full expense, with no expense to me.) My attorney was in full support of this as of January 2001. After trying to contact attorney until June of 2001, i was told by attorney that he "felt" i should cover children and have ex husband pay for coverage. My ex has not paid child support since January 2001! why would he pay coverage?? Attorney ignored my calls for 3 months, and finally returned call stating "he can no longer represent me because i am being "rediculous and unfair"" about health insurance. I feel this is a touchy subject for him on father's rights.
