What is the name of your state? IL chicago

I will minimize my concerns, so auto experts in this forum can give me some ideas or advices. either negative or positive opinions

First of all, at the time of accident, I was uninsured, but other guy was insured. ( but he had new york license and plate), however I didn't give him my insurance infomation, I told him, my insurance was on pending.

He claimed to his insurance co today, and I also called his insurance co to get my car fixed. but since his statement and mine were different, they have to send out adjuster to determine, who's fault it is. then they can decide either pay me or not.

ok here's the my question, I told them my insurance was pending.
and is uninsured do anything with determine who's fault it is?
and If it was found to be his fault and they find out that I was uninsured can they not pay for fixing my car?

Please help me go through this situation.:confused:

No they would have to pay, but by you not having insurance why should they be in any hurry to fork out money to you?

You have no lawyer for them to deal with.

So best advice lean the BUS routes and other public transportation, TODAY!!!

Buy a bicycle and learn how to ride it to work. Or if you think you have a steady job, move so you are walking distance to it.

Just dont expect a quick settlement, thats just a cost you pay for not having insurance.

And expect them to sue you fast if you are at fault.

Thanks....I will take that advise.
does anybody know how adjuster will determine faultness? and does police reports says who's fault it is?
I'm just waiting for original police reports...I hope they have good information.

thats all you can do is get the police reports and if its not right contact the police officer and explain your side and see if they will change it.

If they are at fault, then you can use the money you saved by not having insurance and hire a lawyer to sue them.

I think after this you will realize that you pay one way or the other...

Plus you probably will get your license suspended for not having insurance, so you dont want to make it worse on yourself by driving with a suspened license.

hi, Zappy thanks for the fast reply.
but don't want to put water in your reply...I was the one who's uninsured and they are the one who doesn't have my insurance infos. ;)
But thing was it wasn't police officer who actually filed police reports, it was regular police civilian who works at the police station.
i don't know if that makes big difference and I don't think I can change the info now. Since they sent out their reports to the chicago police station at downtown, records of inquiry section.
I just hope, that police who filed our reports wrote good thing about me. saying that it wasn't my fault.

You missunderstood what i said..if they are at fault, dont expect any money or settlement for months even years until you get fed up, and hire a lawyer to sue them.

Just think of all the money you saved by not having insurance, then use that money to hire a lawyer, if they are at fault.

If they are at fault they will have to pay you, but without insurance they can stall stall stall and stall you.

I'm sorry...I missunderstood what you said.
I'm sure it's their fault, its called 'Failure to control speed/distance' if this law applies in my state IL
hmm...so in worst case, even if they are found to be at fault, they can hold up the payment as long as they can huh?
my option will be then hiring an attorney right?

Yes you will have to hire a lawyer,and pay for it out of your pocket, since you would have automatically would have had a FREE lawyer from your insurance company, if you had insurance.

umm...this can be stupid question. but I have insurance now (day after the accident), do u think they will get me a free lawyer?

Nope, you had to be insured at the time of the accident.

This is what you pay insurance for.. to cover your azzzz.

I called the police(civilian not a officer) who filed our police reports and she told me she wrote down what we exactly told her.
I was making right turn and one lane st and guy behind me hit my rear all the way to front.
so I asked her if she wrote who's fault it is, and she told me in chicago, whoever is in unit one in reports is at fault. btw I'm in unit 2.
and here comes the questions again.
Is unit 1 and unit2 true to other states too?
can other insurer's company can hold my money? if they found to be at fault but they know I wasn't uninsured that time.
if so, should I hire an attorney ? obviously an attorney money have to come out from my pocket right?

They do have to pay you, but when they find out you didn't have insurance or a lawyer, whats the hurry?

Just called his insurance adjuster, but answering machine picked up and said she's in the office...but she never answers the phone.
hmmm...I wonder why.
Hey, Zappy, just wondering what is your current job? I'm just curious, obviously you know good infos about these stuff.
btw, I wrote an email to one of attorney at chicago. we will see what he will have to say about this.
