I am in California.
I have kind of a unique situation and I have a question about it. My ex husband I found out is a cross dresser. He told the court that he did not want me telling our 2 daughters, so I was court ordered not to tell them. I have never told them. He on the other hand has grown his hair long, shaves his legs, has make-up and nail polish in his room. The other night one of our daughters walked into his room and there he was dressed as a woman! He also took them to a eatery where his picture dressed as a woman was displyed (it is a gay community), the girls noticed it right away! He has 30% visitation time.
My question is what recourse would I have in court? Will the court force the children to see a psychologist? Will the court talk to the girls?

I do not understand what your problem is... are the girls being mentally abused or neglected? What is their issue or response?

You don't see a problem with this behavior when the children are there? They are confused, embarrassed, upset!!

I don't understand why he would have the court order YOU not to talk about his cross dressing to them yet he will engage in it when they are in the house. Has he talked to them about it? (It may be better for him to handle it as he will probably have a much more positive opinion of it than you will. If you think it's 'weird' or 'embarrassing' it might make your kids think the same.) Maybe you could talk to him and (if your kids are old enough to understand) he will in turn talk to them.

I don't understand....how can a court order someone NOT to say something that is true? I can see how a court could tell you not to slander someone by saying something that is NOT true.

The court decided that it was in the best interests of the children not to know. However, the father has nulified that order by revealing this secret to the children. Now it is time for both the mother and father to discuss this openly with the children and to explain what is going on.

Why are you so determined to take this to court? Have you and the father sat down and discussed this? Have you spoken to the children regarding this?

If you take it to court, what do you want to happen? What are you after?

Yes I have talked to the father about it and asked him IF HE COULD refrain from this type of behavior when the children are with him. I asked, when will this happen angain and what will they see next? He said he doesn't know!! He cannot control himself, he can't say he won't do this when the kids are with him. All I want is to be assured he will refrain when they are in the house!!

Then by all means.. retain an attorney and take it to court. The judge will either throw the case out or order the father to refrain from doing this in the presence of the children. Failure to do so should result in reduce visitation etc etc..
