I am a real estate agent in the city of Long Beach who works on commission only. My Broker ( who also happens to be my father's "wife" and who is also an agent) has not paid my earned commissions totaling nearly $50,000. When I asked for my pay she retaliated by threatening to fire me.I have no written contract (verbal) but was told I would be an independent contractor.
Over the summer I purchased my 1st home. I took an advance of $30,000.00 from my father with a mutual verbal agreement that there was no payback time for this money. I did in good faith attempt to arrange a monthly payment plan with my father but was told that was not neccessary. Apparently that changed and they have kept all my pay. I haven't been paid in 6 months. I work for them exclusively because I am required by law to work under a Broker. I work full time and then some. My livelihood is completely dependent on my Broker paying me my commissions. My question is can my Broker keep my entire paycheck for money owed? Also, although my Broker classifies me as an independent contractor for tax purposes, could I still be considered an employee of the company because I work only for them?
