What is the name of your state? California

I have been on personal unpaid leave for 6 months now. I have notified my supervisor, and HR several times, however I am still receiving a paycheck. Do I need to return these funds?

At the very least, you need to make upper management aware that you have been paid in error for the last six months. I would VERY strongly advise that you do so IN WRITING and by registered mail so that there can be NO question that you have done so.

IF you are notified by the company that you need not repay the funds, fine, as long as you get it IN WRITING by someone who is authorized to make that decision. But you have NO legal right to those funds and they can sue you for its return. If they do so, they WILL win. It is far better that you get the credit for making the return on your own, rather than having them come after you for it when they discover it on their own. And make no mistake, sooner or later, they will notice it.
