I am having an ongoing dispute over unpaid wages with a foreign national here on a E2 (investor visa). For visa pursposes the business owner (E2 holder) has listed me as an employee of his business, this allows him to prove that he has a legitimate business which is employing US citizens. During my employment I have been treated as both an employee (W2) and as an independent contractor.

The business owner now owes me almost $105,000.00 in unpaid wages. I'm trying to figure out if I should be pursuing this through the Labor board or as a civil suit. does anyone have any insight they can provide?
