Unreimbursed Business Expenses

What is the name of your state? FL

My support obligation was recently increased to 4 times the original amount I've been paying for 5 years. I have unreimbursed business expenses that I must pay just to operate and make the increased money I make. I recently found out that the Judge did not take this into consideration as "business expense" doesn't qualify for an allowable deduction.

When my ex filled out his Financial Affidavit, he put down on Gross Income the amount of income he made AFTER writing off all his expenses for owning his own trucking business.

When I filled out my Financial Affidavit, I put down my Gross Income BEFORE writing off my unreimbursed business expenses.

Is there anything that can be done to lower my support obligation since I bring home NOTHING compared to my Gross after I have to spend my expenses just to keep operating?

you could try to file for a modification based on the error...because as you say this was done recently, the court may not hear it.

My ex tried to get Business Expenses taken out of his Support obligation, but due to the amount he was claiming the judge threw it out...The judge felt that he had inflated the amount, so he wouldn't allow him to take credit for any business expenses......Are you sure this isn’t what happened in your case??

Just to clarify----My ex claimed that he made less after business deductions…. so much less in fact that if he were telling the truth... he wouldn't be able to pay for his rent or feed himself**************...Basically he told the judge that he made nothing after business expenses....And the judge told him he should consider a different profession to pay his support, and keep his hobby on the side………….But the judge used his gross income less taxes for the calculation………

judges can be VERY skeptical of the self employed....on paper my ex (self employed) was trying to show he only made 1/3 of what I make and was trying to get cs from me, as soon as I said it was a seasonal business, and mentioned the amount of cash sales that go through his business, he did the figuring as if we made the same amount of money. no cs either way
