I live in NY. I have been out of work for a little over a week now. I was not fired or laid off. On November 6th I had a meeting with the HR department of my employer. I was told that a "bedbug was found on my chair". They advised me that I was not allowed to come in until I was exterminated. I explained to them that I could not afford it. They were to reach out to their exterminator and the higher ups to see what they could do to help me. I was supposed to hear from them Monday or Tuesday. I did not receive a call. I gave them until today to contact me. Since I did not hear from them I contacted them. Was forced to leave a message. I have not received a call back at this time. I have no income coming in due to this. I am not sure if I am still employed with them. In April 2015 they tried to blame me about bedbugs. I gave them proof that my landlord had paid for treatment back in 2012-2013. I did everything in my power not to get them after this treatment. lost 3 days of work. When I returned they paid me those 3 days I was not there. Due to my job I now have this issue again. I am going to have to start from scratch again. And as it is my landlord does not have to pay to be exterminated as this is a 2 apartment place. I cannot file for unemployment and I am not being paid for this. I am not sure if this is legal or if they are allowed to do this. I am not able to afford a lawyer at this time. But I could use the legal advice.

Why can you not file for unemployment?

No one has to say the magic words, You're Fired, before you can file for unemployment. You are not working and you are not being paid; you can file a claim.

Yes, what they are doing is legal and they are allowed to do this. But if you are looking to have your status clarified, filing for UI is actually a good way to do this, because they will have to explain what they are doing to the UI office.
