Just thought I would post an update on what has happened with the insurance claim in regard to my son's car accident. Below is a copy of my original post which was posted back in March.
My post in March 2006:
My 16 year old son was in an auto accident. The police determined it was my son's fault but no ticket was issued. There were four people in the car he hit. One of the passengers was not wearing his seat belt and was ejected from the vehicle. This passenger received broken bones and a torn spleen. He got a lawyer and wants full policy benefits. Our insurance policy allows for $25,000.00 per person and $50,000.00 per accident. Can I be personally sued for more than the policy limits and lose my house?
Claim Status as of May 8, 2006:
The claim has been settled! A lawsuit was not filed against us. All four individuals who were injured in the other vehicle had the same lawyer. The party who was ejected from the vehicle had medical bills in excess of $46,000. This individual settled for $25,000.00. The remaining three individuals agreed to split the remaining $25,000.00. The claim has been settled and they have signed a release, we can not be sued.
Have I learned anything from this? Yes, you bet. We now have maximum coverage on all vehicles we own and we have a million dollar umbrella policy. Did we dodge a bullet? Yes a big one!!!
On a side note, if you live in a state that has a seat belt law, wear your seat belt! The individual who was thrown from the vehicle was not able to collect the full amount of his medical bills due to his own negligence for not wearing a seat belt.
