Update----Finally!!!!!

Well the time has finally come officially Dad and child win . If you don't remember here is a quick rundown

-I'm the step-mom
-June 2002 Mom got sole legal and Dad got 50/50 physical cause mom moved over 100 miles away.
-Fought and fought and fought for 2 years
-aug 2004 Dad filed for sole custody with mom getting supervised visits due to mom drug use and live in violent bf
-Oct 2004 Primary physical with dad and joint legal mom supervised by her mom EOW. Mom tested positive in court for meth. (dad still pays CS very small amount b/c afraid to ask judge to stop it)
-Dec 2004 supervisor writes to Court to be released from duty
-March 2005 review hearing Dad still primary and has total say over any and all visitation/phone contact. Judge stops dad from paying CS and tells him to file against mom and he will retro back to Oct 2004. Mom has to go 6 months clean random before judge will even consider any other visitation arrangements.


Finally after almost 3 years we can breathe. For all out there who can't see the light at the end of the tunnel keep your head up and stick to your guns. My hubby knows this will never end at least until his daughter is 18 but she is safe for now and that is what is important.

And for any out there wondering yes dad is very agreeable to mom talking to and seeing the child as a matter of fact mom is coming up tomorrow and I will be spending the weekend with her and the child as supervisor. No matter what I think of her or her decisions she is my SDs' mom and they love each other and need eachother. Hopefully getting to spend time with her daughter will give her the strength to kick her bad habits.

After my X wife absconded and secreted my children from me ( i later got her for contempt and CS zero'd out ) , as one of her many sarcastic remarks about me , she told the children I got hit by a Mack Truck .

OP , you are absolutely right , do your research , and stick to your guns .

I had a hell of a time with the CS hearing officer ,and the Family court Judge , but in the end they had no choice but to rule the way they did , and boy were they pissed , especially when I was sent Laws pertaining to the matters on an assemply members letter head , refered by a congress women .
