This is Abstracts wife. I just thought I would give you an update on his court today. He got out about an hour or so ago. Basically, from what he has told me on the phone, Mom perjured herself. Her statements in her disposition were not the same as what she said in court.

In her disposition she stated that she did not send the kids for the past year because she thought they would be in danger here. In court she told the judge that she contacted Dad back in February stating that he could have visitation but that he never responded and this hearing was the firs that she had heard that he wanted that time.

DH brought up that he was having trouble with visitation because mom claimed ignorance about the parenting plan. The judge entered a new plan right in court today. He started to award him visitation this Fall but then mom said that she had plans to travel out of town during that time DH did not argue with it because he really wanted this Christmas. So the judge goes, “ok then he gets this winter then” and mom said that she had plans to travel THEN as well. So the judge basically looked at her and asked when she would be able to find time in her busy schedule for the kids to spend time with dad. She replied that she didn’t see it possible and that she didn’t think that dad should get visitation. THE JUDGE WENT OFF ON HER. NOW… DH has this winter, next spring, next summer, next fall and next winter again. Not only that but mom has to pay for all of the transportation PLUS reimburse us the $3,500 in airfare that we have spent over the past year to get the visitation enforced which she must do by tomorrow night.

Anyways, thanks for the help with the case, it helped him out a lot.

Since we all know that she isn't going to pay the $3500 (and probably transportation costs), did he ask to be credited for that amount in child support?

Oh no she has to reimburse this by tomorrow night or a warrant is issued for her arrest. She is supposed to pay it to him by the time he drops the kids off tomorrow at her house [he got to see them before he flys back]. I think the reason there is the whole warrant thing is because 1800 of that 3500 is from a previous order that she did not pay. Not only that but she can't pay b check ,it has to be cash.

I bet she will pay it. If the judge really went off on her she has to be afraid of losing custody. She REALLY messed up in court.

she may be too stupid to realize the fact that she could indeed lose custody over this......

I'm curious to see how fast mom's attitude will change about having the kids flying alone. Now that she has to foot the bill, I'm sure the kiddies will be fine to fly all by themselves. Isn't it miraculous how things change!
Congrats Abstract, it sounds as though your ex got the kick in the *** that she not only DESERVED but NEEDED. I hope you get to see your kids more often, for thier sake!! It's nice to see that persistence paid off!

She sounds a lot like my fiance's ex.

My fiance still waiting on the outcome of his situation but you have certainly given me hope that everything could work out.

VERY GOOD NEWS!! :D Thanks for coming back to update everyone~ It helps to show that courts are not tolerant of that kind of behavior. ;)

She paid $1,836 (the exact amount of the child support check I just paid). I will be sure to take that and hold on to it but the warrant is now active from what I understand. He issued an order of confinement while we were in court that took effect first thing Sunday. Only think I can do now is sit back and watch the show. Like my wife said, thanks a lot for the help. It just goes to show to the people that come on here and bash that a lot of the advice you get on here actually helps.
