I want to start off by thanking all who responded to my post. All the post has been helpful, in fact they kind of put me in check.
I was the one who sent her children to AR for summer visitation and only one child came home. Here is what happened and maybe it will help others.
The court hearing was on the 8th of Sept. The day before the judge filed a temporary custody order for the eldest child. I was advised to come to AR at least a few days early so that I can visit with my child and well I was not allowed to visit, because the father didn't get the message from his attorney that I wanted to visit. To make it short, children spoke with the judge, youngest was very adamant about staying with me and oldest wanted to stay with dad, well I spent 30 minutes with our oldest just letting him know that I loved him and that I will call him once I got back home, oldest ran back to the judges chamber and told him that he wanted to come home with me and that the only reason he said that he wanted to stay with dad was that he did not want to hurt dad's feelings, well judge said no, and he put another custody hearing on the docket for November 22 and he will make his final decision from there. Here is what the judge is looking at, this may be helpful for others if their child is 12 years old or older in the state of AR.
1- Child's preference
2- Child's mind frame at the time
3- If the child is manipulative or not
4- attitude of the parents
5- Step parents involvement ( no, no, if you are a mouthy step parent)
6- Which parent is calmer or more mature
7- which parent is more likely to be less of a cut throat.
I was told that my son could not be so manipulative, so therefore he has to stay with his dad until November.. I guess we'll see.. Thanks to all, you have gave me great insight and it has helped me...
