update on modification hearing

Hi all, I just wanted to give an update on my modification hearing this morning. It went REALLY well. Dad hadn't picked up from the post office yet the doc's that I filed with the court and sent to him yet. So the magistrate asked if he'd like to review the courts copy. He said sure. So we went to recess. While in recess dad and I went over the doc's and I explained what I was asking for. We came to a total for arrears that he will pay me every 2 weeks for a period of 4 months, and we came to an agreement on the new CS order. And then we just read it to the judge for the record.

Now I have to figure out what forms need to be filled out and filed with the court and what I need to send to da'd employer for the income assignment. That should be fun. The stress I was under has been relieved. I'm so grateful to everyone here who helped me with questions I had and to remind me of the strength I have as a person to do this. :) Thanks so much everyone
 


Last question ladies and gent's I swear! :p

When there has been a modification in child support and it's ordered to be made by income assignment, is there a form that needs to be sent with the new income assignment that tells the employer to stop the previous income assignment? Or do they just know this given that it's the same obligee and case number?

I've seen a lot of posts on here about obligors getting hit doubley on child support and I don't want to do that to my ex. I don't see a form on the self help website for the court for this, so I am not sure if something like that needs to be done.

This is what the notice to withhold income states:
This is a Notice to Withhold Income for Support based upon an order for support from "OBLIGORS NAME". By law, you are required to deduct these amounts from the above-named employee’s/obligor’s income until you are notified in writing by the Obligee, Obligee’s representative, the child support enforcement unit, or the Court, even if the Notice is not issued by your State.

Is my sending this new income assignment considered notice in writting?

If you just wrote that up you may be making a huge mistake quite frankly. There is normally legal language that is required for CS withholdings.

No, I did not write that. That was copied off the domestic court form known as jdf1804 or NOTICE TO WITHHOLD INCOME FOR SUPPORT in the self help off my counties website. I'm just wondering if this form is all I need to submit for the income assignment and if it will end the old one and start the new one? Or if there is something else, which I don't find, that I need to send his employer so that the old income assignment will stop?
