Just an update letting those who care know, they picked up my ex today... FIVE days of calling to tell them exactly where he was, and they finally picked him up. Now he has six months to think of his responsibilities and how he wants to take care of them!!!!!

They sentenced him to a certain amount of time? HUM...

In the county I live in(not the one my order is in damnit) they put them in jail but on work release in order to pay off the debt. They can work 3 jobs for all they care.. the more they work, the faster the debt is paid off, the faster they get out of jail.

Things work slow in Tennessee. Except for the traffic and turn signals. They don't work at all.

So, if a person manages to rack up a really big CS arrearage, they can get free lodgings the rest of their lives at the jail each night?

Again my orders aren't here so I don't know ALL the legalities.. but I believe they give them a time limit as far as I know and they take so much percentage out of their pay. Guess it depends on the deadbeat if they prefer jail or freedom.

The Judge told him back in sept of 02 if he missed one single payment, he would spend 6 months in jail or he could pay the entire 21,990(At the time~now it is around 27000) CS arrears he owes me. I don't know what happens from here, or when he gets out.. but I know the judge is getting a bit upset with him. It was written into our last set of court papers that way...

Tell me about how slow things are... the mittimus was issued Jan 30, 2003. So one year, 3 months 15 phone calls over five days, a trip to the courthouse to get a copy of the mittimus then to the sherriffs dept after I was told on friday that they didn't have anything on him, and they finally get him.

Honestly I wish they would put him on a work release program, at least then he would HAVE To pay something. I just want him to take his responsibilities seriously... and since it is written into our courtorders that he is supposed to provide ins, and he lied to me for a month, and now I have to get it, that isnt making my feelings towards him any nicer...He needs to be held accountable for his actions or lack of in some cases...

I know there are some out there that don't agree with jail time for deadbeats but I for one do. I tried to get charges filed on my ex who is over 23,000$ behind and CSE told me (and I quote) "It is a long process that changes the goal from payment to punishment" I told them I didn't care. I wasn't getting anything anyways, hadn't in years and I wanted him held accountable. Work release is better but for the ones that refuse no matter what jail is the best place for them.

I totally agree. He has been given chance after chance after chance. He knew the consequences of not paying that last time...They bring it on themselves...

It took three-four years of going to court all the time for contempt for the judge to finally tell him that. I hate that your CSE won't even bother, Tigger, that is bull.They should do whatever it takes, that is their job....

Yeah, they always had an excuse. The last one I got was that they don't file charges in cases where the children no longer live in that county because they can't guarentee the CP will show to the hearing and they have to. All they do is continue to set up court dates thinking it pacifies me but doesn't get him served so the court date gets cancelled. We've had 6 scheduled in 3 years and yet to go to court. They did finally suspend his lisence but the reality is that if he's ever pulled over for driving the most he can get is 'driving while suspended'. Oh well, our TPR will go through this month and I won't have to worry with it anymore.

IT is ridiculous!! My ex's wife called from the DA's office today wanting to know if I would "make a deal" She said "He's been trying, everyone deserves a second chance" I said, yep, and I gave him that chance about 10 chances ago. He KNEW the concequences, he KNEW what he had to do, They have lied to me they have stolen from me, they have been nothing but difficult. So nope, I said no deal, he should have thought of that in Sept of 02 and not waited till now to think of it and feel sorry. I told the DA I didn't believe anything they said and she said she never believed anything he said...

She told his wife the most she could do was try to get him in front of the judge and maybe on a work release program... I agreed with that... but that is all. I am waiting on the rest of the storm, I have a feeling it is not over with and this is the eye of the storm... Tigger, I hope things work out for you. My husband said(completely unprevoked) that we should let him sit for a week or so and then tell him he can get out by signing away his rights. I said, you realize that means you would have to adopt them, he said "I know, they are more mine anyway, you know I love them" About made me cry...
