Previous thread above....so had the scheduling hearing today and this is what happened



we have a half day hearing on Tuesday November 24th at 1:30

what was said in court....lots for a scheduling conference

1. I kinda got my oral motion for dicovery granted, I say kinda cause the judge asked them about it, and they said it could be sent today so the judge told them to send it out today- hey verbal order is just as good

2. They are sending me interrogatories...this should be fun- no really I'm serious, I love this stuff

3. KIDDO apparently told the GAL he doesn't want to come back to my house ever, this from a kid who tells me that he likes it at my house because he's treated like a big kid and given respect even if he has more chores than at dad's

4. The GAL said all of Ex's concerns were real "nebulous" but that neither one of us had proven our concerns yet to her- I think Skeletor's police record speaks for itself, but I can prove my claims at the hearing

5. Ex's attorney has to make Skeletor available to testify or she will be subpoenaed (she's done a good job at laying low for court stuff)

6. After the judge said that the GAL said, well judge there is a restraining order in place....which is funny because the restraining order keeping her away from me expired a long time agao but the judge still heard it LOL, the judge just told the clerk to make sure there was adequate security that day.

7. Ex's attorney said that Ex's position is, if this goes to contested (hearing) then KIDDO probably shouldn't have to give up his normal kid stuff all the time to go visit his mom, he should be able to visit and do stuff with his friends. Meaning KIDDO shouldn't have to spend the summer with me

8. Ex's attorney made reference to KIDDO seeing a counselor for quite some time now, I have never been informed of any medical or other care being sought for him

that's all I can think of right now



So....some questions


1. I know no one has a crystal ball, but how much weight REALLY do courts put on the refusal to co-parent?

2. It appears that their position is if I follow this through is to minimize the time KIDDO and I spend together. Can they do this without ever having put their own motion to the court for that? They have never filed any responses or counter motions.

3. How in the world do I put before the court the slow and systematic errosion of the relationship betwen KIDDO and I to make them understand what is going on and have them take it seriously?

4. How do I make Skeletor implode on the stand?

I'm sure I'll have more questions, but I'll leave it at that for now

I fling myself upon the floor in despair! I don't know any of that sort of stuff, really, and certainly not in your state. :(

I'll think on implosion methods, though...I'm stunningly good at making others implode. ;) (What? It's true! :D)

she seethes (really) with hate for me, and if her police recodr is any indication, she certainly has an issue with self control, rather a lack of, so I am thinking it should not be too hard at all to make this happen

Well... of the 8 best interest factors that my court recognizes, the ONLY one that was used in determining whether or not I won my case was which parent was most likely to foster frequent and meaningful contact with the other parent. And co-parenting falls squarely into that realm.

They never even ANSWERED? Ugh.

In general, no... they can't be granted something they didn't request. Which is why the ... proper... thing to do is to ask for the earth and settle for some sand.

Well, that's SUPPOSED to be what the GAL is for. But I honestly think you have enough w/the school records and the interference and the refusal to communicate and the denied time and the fact that the reason he HAS custody is based on the child's ability to spend time with YOUR extended family and that's not happening...

4. How do I make Skeletor implode on the stand?

I'll leave that to Silver... and steal her ideas for my own step-monster.

Did he say this in front of the JUDGE?:eek: If so, I can't imagine that that scored him any brownie points.

I'm gonna have to GO THERE to WI...there's only so much I can impart over the internet. At least half of my implosion tactics involve a certain posture...a subtle look (not a sneer, for that would be unattractive)...a hard-to-pinpoint attitude that sends people right over the edge.

what do you have that would be totally unnoticable to onlookers...say a judge or GAL????

I have no doubt I can get her to say she is the perfect mommy for KIDDO, I can make her look stupid on the stand, but I want these people to understand who really is being destructive here

The easiest way to make her implode if she hates you is just smile sweetly and - constantly smiling at her -- ask her questions in a nice Mary Poppins voice.

no that I can do....imploding witnesses usually aren't good for their sides case are they.....I would hope not, cause I plan on her imploding

Nope, imploding witnesses aren't good. I like them (unless they are my clients). I also like dumb witnesses.
Actual testimony in a trial -- I (as Plaintiff's counsel) and the defendant had the following exchange on cross examination:

Me: You told Plaintiff that your family would lie for if need be didn't you?
Defendant: Yes I did because they would. Anyone's family would lie for them.
Me: Thank you. No further questions.
Magistrate: You may step down. Your next witness.
Defense attorney: Your honor, we would like to call the defendant's sister to the stand.

Gotta love it. :p

So pray for imploding witnesses or dumb ones.

Have you checked out ideas on deltabravo.net? They have some good ones when dealing with alienating parents.

Sorry you are going through this...this is the type of behavior is what creates SO MUCH litigation in the Family/Domestic courts.

Thanks CASA, I forgot to mention before that when the GAL questioned him about why he didn't want to come to my house he steadfastly refused to say anything further...would not/could not give her one reason

I will check out delta bravo right now....I want the court to realize what's happening but can't go in there yelling "alienation"

Right...but you can identify, give examples of the alienating behavior. That is the worst type of behavior in parents. Hopefully that transmits & the judge sees the behavior for what it is ~ a long history of calculated manuevers to remove you from the child's life.
