there is the original thread. i said i would update so i could tell ya who was right and who was wrong about what i would need to have to prove i am paying my mother for daycare services.
We are apparently not appearing before a judge as i first assumed. We are going before our case worker whom we explain our case too...the computer is going to pop out a number with the support formula...if my ex doesn't agree then we will be sent to the master(im guessing that means judge) and my case worker told me, that the master will just enforce the computer amount. he's seen it done a million times with family members and the county i am in, apparently, is very accepting of family members being paid for child care services when parents do not want to put their kids into daycare and weigh heavily in favor of the CP.... so here is what i was told i needed so that there wouldn't be a problem:
Copy of last years' tax return, Pay stubs from last 6 months, offer letter of employment from my work stating my future salary, notarized letter from my mothers employer stating that she is voluntarily leaving to assist in childcare of her grandaughter, notarized letter from my mother stating exact amount of payment and how it is to be paid, this big income expense sheet that i have to fill out and proof of daycare costs in the area relevant to the amount i am paying my mother for comparison.
he told me that he will input my future income into the formula as well as my ex's (which WILL include his BAH dependants pay that they will determine based on a chart they have) because apparently i'm not the only one who has dealt with military pay. He will also input the $600 amount as the "CP's" (mine) daycare expense to be factored into the OVERALL equation for CS. he said they don't separate and itemize how CS will be allocated..they just take the expenses and our incomes and put them into the computer and out pops a number that a master will sign off on if contested 99% of the time. the one caveat is, that i will have to produce documentation in the form of voided checks every month(if my ex goes to court and requests it) and my mother must file earned income in 2010 for $600 a month or can be held liable for tax evasion. basically the county I am in, from what my case worker said, has judges apparently that lean majority in favor of mothers and CP's.
so that is what i was told by the person who will be handling the case....not sure who had said what about opinions as to what i'd need but there ya go.
