URGENT question about POA

A friend's husband has had a stroke and is the hospital. He has periods of lucid moments but he comes and goes. Does the wife by being married have Power of Attorney or does she have any right to say what happens with his healthcare if something happens while he isnt lucid. Also, he has a daughter..from another marriage and she insists on coming and removing her father and taking him to a hospital where she lives, cans he do this? Does the wife need to file something at the hospital or go to the courthouse and file some emergency thing there? Thanks for all your help.

Tell your friend to see the Hospital Administrator who will assist her with papers for an emergency Health Care Surrogate/Health Care Proxy. These papers need to be taken to the courthouse. Should your friend's husband also require a temporary emergency guardian, she can apply for that at the courthouse at the same time as she is applying for Health Care Surrogate/Proxy. Then, your friend can tell her husband's daughter to bite rocks. The daughter has no right to remove her father from anywhere.
