In 1997 aprx my employer used my photograph in a brochure. I was a mechanic at the time and the caption reads all vehicles are inspected. Since that time a web site has replaced the brochure and my photo is still used today. The business went from a 100k per month business to 1mil per month business and I recieved 0 for the use of my photo.(1)is it legal to use my photo without consent? (2)Am i entitled to any proceeds for the use of my photo? Thank you for your time.

I assume you consented to the taking and use of the photo.

Use of YOUR photo has had NOTHING to do with the growth or success of the business, and asking for money now just appears to be pure greed and envy. Get real.

Even if you had a right to have it removed (and I don't know if you do) they'd get another photo of someone more photogenic who would pleased to be photographed and have it posted where a potential movie director might see it. And as for suing for use of the photo, courts and juris don't award big damages to guys who appear vindictive and greedy.
