I've had custody of my daugter since May of 2001, my exhusband has not been ordered to pay childsupport. I am currently in the process of having him ordered to do so. After filling out my fincial papers, the lawyer my exhusband has wants all the information about what my current husbands income status is, as I am not currently working. Why do they need to know how much money he has made over the last five years, and, can they use that for the basis on my exhusband NOT paying any support? Also, when my exhusband had custody he did not want childsupport for several years, unknown to me, he was collecting AFDC from the state of Florida. Under oath at one of our many court hearings for me to pay support, he admitted to fraudulantly collecting AFDC because he didn't turn in all his income and he was paying for our child to attend a private school. Nothing has ever been done about this. At that time I was ordered to pay back child support even though he collected AFDC. When my current husband filled his income tax returns to the IRS, they took his returns and said they were attaching them to the back childsupport I owed the state of Florida. All that was paid back and now the state of Florida is still saying that it was never paid. How do I go about finding where they sent the IRS refund to? And can I now have my exhusband pay me back child support from the time I got custody, even though he was not ordered to pay any, neither was I?????
