I work part-time at a health club as a private fitness trainer. It was just announced that employees who work less than 30 hours per week will receive vacation pay of $7.50/hr versus their normal hourly rate! I know it is not ethical, but is it legal?

Since the company is not legally obligated to provide paid vacation AT ALL, I don't see any reason why not.

Calif spa vacation pay

California is one of the few states that require an employer to pay out vacation as it is EARNED, not what may be "accrued" on the books -- this may add an interesting wrinkle. Ask your employer how many hours of vacation you receive for your position and years of service and employment status (part-time). Is it the same as you had before, or does it now equal $7.50 per hour (with fewer hours actually being given). Could be a shadowy attempt at a benefits reduction. :cool:

Vacation Pay is "Wages Earned"

California law designates vacation pay as wages earned. Vacation pay is not required, but if it is offered it is accrued as you work during the course of the year at the wage that you earn. Therefore if you get a week of vacation (5 days) during the year and you're paid $12 per hour. You "earn" a percentage of your vacation pay each week at $12.00 per hour. They cannot pay you a lower rate under California State Law.
