What is the name of your state (only U.S. law)? Missouri I have worked for this company for a little over a year. Started out part time but always worked full time. They are dening me vacation pay saying I was not a full time employee for the whole year. Can they do this. They have let me contribute to my 401k plan durning this same time because I've met the hours required.

The laws regarding 401(k)s and the laws regarding vacation are not the same. 401(k)s are governed by Federal law; vacation is governed by state law. Employers are required by law to follow the plan document of a 401(k) absolutely to the letter. But the plan document of a 401(k) does not govern who is eligible for vacation.

In other words, if you are eligible for a 401(k) after 1000 hours (for example) but you are not eligible for paid vacation until you have been a full time employee for a full year, that does not violate any laws.

Likely the definition of "full time" is not the same between the vacation policy and the 401(k) plan. Perfectly legal.
