I have already filed Chapter 7 bankruptcy. My trustee meeting is set for August 31. In my bk, I have stipulated that I will surrender a vehicle which blue books at $8000. I owe $13,000 on it. In an incredibly stupid move, I loaned the vehicle to a friend who totalled it (fortunately, he was not hurt). I had discontinued the insurance on it and my friend, as it turns out, is not insured (before taking it, he lied and said he was). I have a lawyer who is tied up with jury duty and has not been able to get back to me to advise me what to do. I'm obviously in a panic. Does anybody have advice for me?

I'm not sure I understand. In my statement of intentions, which was filed before the vehicle was totalled, I already said I was giving the vehicle back.

Sorry, my bad :rolleyes: , I mis-read.

Since you already said you were giving it back, then I don't see where the problem is.. let the bank worry about it. I'm not sure what other consequences may turn up letting an uninsured driver take out an uninsured vehicle. Are you not required to keep the insurance up in CA ??
