A little over a year ago, my mother rented her farm to a couple and their children. They said that they would only need to rent for 3 months and then they would be ready to buy it, my mother never had a contract with them regarding anything. After 9 months of them renting, with no contract, I took over my mother's financial business. My mother had a mild stroke and made me power of attorney. I sent them a letter in Jan. stating that they had until April 1 to come up with the financing or they needed to leave and I'd sell the farm through a real estate agency. We called them early March, just to check in and see if there was anything the bank needed from us. We were told that they were working with "x" financial place. We called that place and they'd never heard of this couple. Then on 3/28, they called to say that they were working with "Bob" at "y" financial place. We called him to see what he would be needing from us. (I'm 100 miles away from my mother and property and can only do leg work on the weekends. I like being prepared) Bob said that due to their credit, we would need to run this mortgage through like a 2nd mortgage and we needed to get a land contract and back date it for 1 year so it would look like their rent was actually making mortgage payments to us. I didn't like this idea...something just seemed wrong, but I went ahead and purchased it. We went down this past weekend to have them sign it and the place is a MESS, trash in the yard, they've added a wall tothe living room, took out kitchen cabinets, broken windows, etc.! My son. who's 16, went back to the woods to say goodbye. When he came back up, he asked me a few questions about things he'd seen in the woods. To make a long story short, they had trees marked for loggers to come in and buy timber. When we asked the tennant about this, he was honest, and said that he had a buyer come in and was offered around $5000.00 for a certain amount of trees. My mother, who was there, was furious!! When she rented, it was made clear that they were just to rent the house, not the woods. She decided not to have me sign the land contract to sell the house. We have filed papers to have them evicted. The tennant called to say that he has witnesses saying that my mother has verbally agreed to sell him the farm and he was getting an attorney. Do we have anything to worry about or should I get an attorney also? HEELLLLPPPP!!

Proceed with eviction and if one piece of bark is missing sue their collective asses for damages.

They have nothing. Any real estate transaction, to be valid, MUST be in writing.
