I am a 52 Year Old Insurance/Healthcare
claims executive who after a full day
interview with an NC HMO was offered the
Claim Director position through an
executive recruiter.

We negotiated a starting salary, front
end sign-on bonus and set a starting
date. I verbally accepted this position
and was advised by the recruiter to
contact the COO, who I would be
reporting to, from this point forward.

I was in contact with the COO who
congratulated me on my joining the
company. I also spoke with one of his
direct reports, who I interviewed with,
and she also was congratualatory about
my acceptance of this position.

The recruiter was in contact with
several of my references and advised
them how she successfully secured this
wonderful opportunity for me in addition
to discussing my good fortune with my
wife.

The recruiter contacted me to make a
second visit to NC so I can meet with
the owner of the HMO. She advised at
this time that this visit would be more
of a search for a home or apartment and
that the job was mine. I verified this
same information with the COO. There was
no mention whatsoever that the Owner
would be the final decision maker.

I just returned from the 2nd visit and
met with several excutives in addition
to the owner. Prior to leaving I was
advised by the COO that the Owner would
probably rubber stamp my hiring and at
this time, the first mention, I learned
that my hiring was contingent on the
owners opinion.

Prior to the 2nd visit and after I
accepted the position, I gave notice to
my Apartment complex of my move out date
and began the search for an apartment in
NC. I also turned down a very good
full-time consulting position thinking
this job was a lock. I would have
started this consulting job on Monday of
this week if I wasn't in NC for the 2nd
interview.

I have now been advised that this job is
being reviewed for necessity and that
the Owner will decide on my hiring
status.

My question is on liability...Is the
verbal agreement I had with the
recruiter and the COO an implied
contract? I made decisions on my current
living status, spent considerable time
searching for new living arrangements,
turned down another job offer believing
I had this job. Lost wages for the 3
days I spent in NC for the 2nd interview
when I could have been working
elsewhere.

I can obtain statements from my
references indicating the Recruiter
advised them I accepted this position.
When I was on-site this week the COO
introduced me as the new Claims
Director. I had every indication that
this job was mine....and now it appears
to be gone.

What options do I have...if any?

Interesting case -- were you being given an employment contract? If not, in theory, the firm could have fired you the day after you started. Contact a NC employment lawyer -- but suing a prospective employer is not likely to get you a new job.
