undefinedWhat is the name of your state?Florida :mad: What I would like to know is this...If you are in violation of probation from 1998 on a dui and you thought that it was all done.....Just how long can they hold you in jail for? And is there any laws stating that if you are wanted on a warrent(bench) for another charge which you knew nothing about as u r a Canadian and you crossed the border in Detroit and got flagged and are waiting to be extridited to Florida and then get to Florida and then are told that you had this violation of probation? I guess my question is can someone be held in jail for 30 days without getting to speak to a judge about all of this mix up? Any help would be great?

Usually, they are able to set a court date within a week or so, I don't think you would have to sit in jail for 30 days unless someone told you that. If you have an opportunity to bail out on this I would! Or...this person can wait until a court date is set. Unfortunately, no law against not knowing about a warrant.

Generally, yes it takes about 30 days to get an extradition.

You can be held in jail as long as the sentence was you got when you were first put on probation, after you are given credit for time served (if any).

I guess I do not see where the mix up is. You got caught and you're in jail.

What is the mix up?
 
A Canadian crossing the border in Detroit gets flagged for outstanding warrant in Florida. (Which side of the border we do not yet know)

This Canadian is then extradited back to Florida.

This Canadian is held 30 days without hearing for a probation violation that is not a violation as this violation is a mix-up.

There is an outstanding additional warrant out there this Canadian did know nothing about. Again another mix-up.

Presumably this same Canadian is our poster.

How is this possible, helplessme?
