What is the name of your state (only U.S. law)? South Carolina

My question is in regards to the seizure of private property and by that seizure a violation of my right to due process under the Constitutions 14th Amendment.

Title and Deed to the private property in this case were granted and recorded in the county court house since 1898 and have never been disputed or challenged until recently.

The State Government along with a Corporate entity decided that with regards to the property in this case that it would be better served for the property to belong to the State and managed by the private corporation.

Without so much as a letter or a phone call or without any type of notification, the property (minerals) was taken.

Wondering if this is a violation of my civil right to due process under the US Constitution as well as the State Constitution and what type of punitive and or monetary damages could be result.

I assume you are talking about eminent domain? There is definitely due process in that procedure and an established body of law to protect your rights. Given the rather incomplete description and the fact the stakes are high if you get this wrong, this is not a self-help process. Get an attorney. You don't start this one by arguing constitutionality.

This thread was created in December of 2014 and Zigner provided the best answer for the question posed by alarmtech.

Please do not revive old threads just to repeat what has already been said by others. Not only does it serve no purpose, it bounces off the main board the current concerns of new posters.
