Generally, it's time for a modification taking school into account. How it's modified will turn on any number of things.

The paperwork is in the process to modify visitation because the NCP has changed to night shift w/ increase in pay 2p.m. to 10:30p.m. m-f

original order was every wednesday 4:30p.m. to 7:00p.m. and e/o weekend from fri @ 5 p.m. to Sun @ 6 p.m.

NCP wishes to change original order to e/o weekend from Sat @ 10 a.m. to Mon @ 12 noon and every wednesday from 10 a.m. to 12:30 p.m.

The subject of preschool came up and NCP agrees to take child to preschool e/o Mon in the event the new visitation request is ordered and the child is enrolled in preschool.

However, that would leave wednesday visitation out for NCP since child would be in school during the day and NCP would be at work in the evenings.

How can the NCP make up that time?

CP has stated that her work schedual is flexable.

These issues have been through court ordered mediation in which CP would agree with nothing.

any help on this matter would be appreciated.

Okay, this is really making little sense to me. For starters - preschool is not a necessity and shouldn't require a modification. Second - NCP is getting the same number of hours (actually, a bit extra) with the proposed modification. There is nothing to be made up.

I'm curious if I can make up the time I would miss... wednesdays 10 to 12:30 when or if she goes to preschool and eventually school.

Oooh, I get it. You want to modify now for the 10-12:30, and want to know if you'll get that time back when she starts school. How do you see that working when she's in real school? She's not going to be able to simply miss half a day eow. Unless you can see her after school once that happens, you'll probably lose that time.
