I am in desperate need of legal advise. I am from Wheeling, West Virginia my husband and I have been divorced since November. We have a 5 year old daughter toegher. He has moved to another state, York, PA. I have full custody of our daughter and he does receive visitation rights, which he does not use. He is to get her every third and fifth weekend of the month. He has asked to see her for the holiday weekend, I agreed to let her stay with him at his residence. I will meet him half way to drop her off to him (3 hr drive). She is to be back to me on Monday the 28th, I have a freind who will be traveling that area to pick her son up from her ex-husband and offered to pick my daughter up for me to save in gas expense. My ex-husband is refusing to let our daughter go with my friend. Does he have the right to refuse her if I say it is o.k.?

Are you ordered to supply half of the transportation or is that an agreement between the two of you? If you are not court ordered to supply any part of the transportation, you then can tell him that if he wishes not to allow your friend to drive her back that is fine; he will then need to return the child at your residence at XX o'clock on Monday.

Now, if you are ordered to supply half of the transportation than this is a simply case of one parent refusing to make things *easy*. He need not to let the child go with the friend, he can meet you halfway as ordered. If this is the case, he is just being nasty and uncooperative. Thats all.
