We live in Ohio. My husband lost his job and is currently looking for a new one. His ex wife is upset about it because she may miss a child support payment (they took one our of his last check & she hasn't received that one yet). It's understandable that she is upset about it. Because of everything that is going on, we also lost our apartment & we are staying with some friends. There is plenty of room here & when we have the 2 kids on our weekend, they have come over here & they sleep on the couch & loveseat just like they did at our apartment. My husbands ex is now telling him he cannot keep the kids overnight anymore on his weekend because they are sleeping on the couch & there are too many people in the house. She is also threatening not to allow him to see the kids if she doesn't get child support, can she legally do any of this???

What most CP don't realize/understand child support and custody/visitation are TWO separate matters. Even if you fall behind in payments, that is not a reason to deny visitation. If she choses to do so, that would be contempt of court and a police report should be taken, so this is a continued issue for the two parents involved.

She cannot deny your husband visitation because of the missed child support payements. And unless there is a court order that your husband needs to supply the children with beds/bedrooms each visit, there is nothing she can do about that either. As long as they have a roof over there head, and they are safe; it's ok.
